Scope of Services & Acceptable Use
AMS Resources provides executive recruitment, permanent candidate placement, contract staffing, and workforce management consulting services. Users agree to access the platform strictly for legitimate job recruitment and talent sourcing purposes.
Prohibited Conduct:
- Submitting fraudulent, altered, or false qualifications, work history, or identity documents.
- Utilizing automated bots, web scrapers, or data mining software to extract candidate details or client job postings.
- Attempting to bypass database authentication or breach Applicant Tracking System (ATS) security.
- Using contact details obtained from AMS Resources to send unsolicited promotional spam.
Candidate Obligations & Warranties
By uploading a resume/CV, registering a candidate profile, or participating in placement interviews arranged by AMS Resources, Job Seekers agree to the following:
- Data Accuracy: You warrant that all information provided regarding educational qualifications, previous employers, compensation history, and legal right-to-work status is complete and accurate.
- No Guarantee of Placement: Submitting a profile or participating in an interview does not guarantee job selection, an interview invitation, or a employment offer from client companies.
- Authorization to Forward Records: You grant AMS Resources the right to store, parse, and present your candidate profile and CV to client employers evaluating candidates for matching job openings.
- No Employment Relationship: Registering with AMS Resources does not establish an employer-employee relationship between the candidate and AMS Resources unless an explicit temporary staffing employment contract is executed on our payroll.
Client & Employer Obligations
Client companies engaging AMS Resources to source talent agree to adhere to strict candidate confidentiality standards:
- Confidentiality of Candidate Profiles: All candidate resumes, assessment reports, and contact records shared by AMS Resources are strictly confidential and intended solely for internal evaluation for specific vacancies.
- Precedence of Master Service Agreement (MSA): Commercial placement fees, candidate replacement guarantees, billing milestones, and payment terms are governed by a separate, formal Master Service Agreement (MSA) or Commercial SLA signed between AMS Resources and the Client. In case of any conflict, the signed MSA/SLA shall prevail.
Service Disclaimers & Limitation of Liability
To the fullest extent permitted by applicable law, AMS Resources, its officers, consultants, and agents shall not be liable for any direct, indirect, incidental, or consequential damages resulting from website downtime, database errors, or final candidate hiring decisions made by third-party employers.
Intellectual Property & Website Rights
All brand graphics, logos, website copy, search layouts, and proprietary recruitment methodologies used on this website are the property of AMS Resources. Users are granted a limited license to access the site for personal job application or hiring needs only.
Governing Law & Dispute Resolution
These Terms & Conditions shall be governed by and construed in accordance with the laws of India. Any legal proceedings or claims arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the competent courts in Kolkata, West Bengal, India.
